Please read these Terms of Service ("Terms") carefully before using BrainText. These Terms form a binding agreement between you and AMARIA, a société par actions simplifiée registered in France under RCS Paris 908 714 330, with its registered office at 122 rue Amelot, 75011 Paris, France ("BrainText," "we," "us," or "our"), which operates the BrainText brain-games service delivered over WhatsApp (the "Service").
By messaging BrainText on WhatsApp, playing a game, submitting a puzzle, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Service.
- What BrainText Is
BrainText is a daily brain-games service delivered entirely through WhatsApp chat. You message us to play, and we reply with puzzles, track your scores, streaks, and standing relative to other players, and — where you choose to share it — personalise your experience (for example, by referencing your university).
The Service is user-initiated: we only message you in response to messages you send us. We do not send unsolicited reminders or promotional broadcasts.
- Eligibility
BrainText is designed for university students. To use the Service, you must be at least 16 years old, or the minimum age at which you can lawfully consent to use of online services without parental permission in your country, if that is higher. Consistent with our Privacy Policy, the Service is not directed at children under 13, and no one under 13 may use it. If we learn that someone under 13 has used the Service, we will delete their data.
By using the Service, you confirm that you meet these age requirements and that you have the legal capacity to enter into these Terms.
- Your BrainText Account
There is no separate sign-up. Your WhatsApp phone number is how we identify you and associate your gameplay, scores, and streaks with you. You are responsible for:
keeping control of the WhatsApp account and phone number associated with your BrainText activity; the accuracy of any optional information you choose to share with us (such as your university or school); and any activity that happens through your WhatsApp number when using the Service.
If you lose access to your WhatsApp number, or believe someone else is using it to interact with BrainText, please contact us at hello@braintext.co.
- Free of Charge
BrainText is currently provided to you free of charge. We do not collect payment information and do not charge for access to games. If we ever introduce paid features, we will tell you clearly what they cost and will not charge you without your affirmative agreement at the time.
Standard messaging or data charges from your mobile carrier may still apply to your use of WhatsApp; those are between you and your carrier and are not part of the Service.
- Acceptable Use
You agree to use BrainText only for its intended purpose — playing brain games and, if you choose, contributing puzzles — and not to:
attempt to cheat, automate, or manipulate scores, streaks, or leaderboards (for example, by scripting messages, using bots, or exploiting bugs); submit puzzles, answers, or other content that is unlawful, defamatory, harassing, hateful, sexually explicit, or otherwise objectionable, or that infringes someone else's intellectual property or privacy rights; impersonate another person or misrepresent your affiliation with any university or organisation; probe, scan, or attempt to interfere with the systems that run the Service, including our messaging integrations, databases, or scoring tools; or use the Service in any way that violates applicable law or WhatsApp's own terms of use.
We may suspend or terminate access for anyone who violates this section, as described in Section 10.
- User-Submitted Puzzles
If you choose to submit your own puzzle questions to BrainText, you retain ownership of what you submit. By submitting a puzzle, you grant BrainText a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, publish, and distribute it as part of the Service (for example, sending it to other players, editing it for clarity, or including it in a future puzzle set), for as long as we operate the Service.
You confirm that anything you submit is your own original work, or that you otherwise have the right to submit it, and that it does not infringe any third party's rights.
- Gameplay Data and Automated Scoring
Your answers, scores, completion times, streaks, and which challenges you have played are recorded so the Service can function, as described in our Privacy Policy. Where a puzzle calls for an open-ended answer, your response may be sent to OpenAI for automated scoring; it is not used by us or by OpenAI to identify you. Scores generated this way are provided on a best-effort basis and, occasionally, automated scoring may be imperfect.
- Third-Party Services
BrainText depends on services we do not operate, including:
WhatsApp Business Platform (operated by Meta), through which all messages are delivered. Your use of WhatsApp itself is governed by Meta's own terms and policies. Google Sheets and Redis, used to store and temporarily cache your gameplay and account data. OpenAI, used to score open-ended puzzle answers, as described in Section 7.
We are not responsible for outages, changes, or policies of these third-party providers that are outside our control. If WhatsApp becomes unavailable to you for any reason, we may be unable to deliver the Service to you.
- Intellectual Property
Except for content you submit under Section 6, all puzzles, game formats, scoring systems, text, graphics, and other materials that make up the Service, along with the BrainText name and any associated branding, are owned by AMARIA or its licensors and are protected by French and international intellectual property law. Nothing in these Terms transfers any of that ownership to you.
You may play the games and use the Service for your own personal, non-commercial enjoyment. You may not copy, redistribute, or create a competing service from our puzzles or scoring formats without our prior written permission.
- Suspension and Termination
You may stop using BrainText at any time by sending "STOP" or simply blocking our number in WhatsApp, as described in our Privacy Policy.
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, misused the Service, or if we discontinue the Service generally. Where practical, we will try to let you know first.
- Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the extent permitted by applicable law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available at all times, or that scores or automated grading will always be accurate.
Nothing in this section limits any statutory rights you have as a consumer under French or EU law that cannot lawfully be excluded.
- Limitation of Liability
To the maximum extent permitted by applicable law, AMARIA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of, or inability to use, the Service.
Because the Service is provided free of charge, our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us to use the Service in the twelve months before the claim arose (which, currently, is zero), or (b) €50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable French or EU law, including liability for death or personal injury caused by negligence, fraud, or wilful misconduct.
- Indemnification
You agree to indemnify and hold AMARIA harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or content you submit in violation of Section 6.
- Changes to the Service or These Terms
We may update, modify, or discontinue features of the Service at any time. We may also revise these Terms from time to time; when we do, we will update the "Last updated" date above. Material changes will, where practical, be communicated to you through the Service. Your continued use of BrainText after a change takes effect means you accept the revised Terms.
- Governing Law and Disputes
These Terms are governed by French law, without regard to its conflict-of-law principles. If a dispute arises that cannot be resolved informally, the courts of Paris, France will have exclusive jurisdiction, except where mandatory consumer-protection rules give you the right to bring proceedings in the courts of your own place of residence within the EU.
If you are an EU consumer, you may also be entitled to use the European Commission's Online Dispute Resolution platform, and, as noted in our Privacy Policy, you can raise data-related complaints with the CNIL.
- General
Severability. If any part of these Terms is found unenforceable, the rest will remain in full effect.
No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Entire agreement. These Terms, together with our Privacy Policy, make up the entire agreement between you and AMARIA regarding the Service, and supersede any prior agreements on this subject.
Assignment. You may not assign or transfer these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
